By accessing or using AirtekShop.com or any Airtek Services, you confirm that you have read, understood, and agreed to our terms and conditions under the Terms and Conditions section and the Privacy Policy section, along with any applicable laws and regulations.

ORDERS, SHIPPING AND DELIVERY

Placing an Order

  1. Before making a payment, please double-check that the correct product is in your shopping cart and that all required information, including your company name, shipping address, contact person, email address and phone number, is accurate. The provided information will be used for shipping and delivery.
  2. If you order the wrong product or one that does not fit your needs, you will be responsible for all related shipping charges.
  3. If incorrect information is provided when you place the order, resulting in an undeliverable shipment, you will be responsible for all related shipping charges.
  4. If you encounter any issue or make an error while placing an order, please contact your local Airtek Shop or your Account Representative promptly. Our team is ready to assist you and ensure a seamless and enjoyable shopping experience.
  5. Airtek strives to provide accurate information online. However, in the event of typographical errors, inaccuracies, or omissions, including those related to product descriptions, pricing, promotions, shipping costs, delivery schedules, or product availability, Airtek reserves the right to correct such errors, update the information, and/or cancel orders at any time without prior notice. Airtek is not obligated to honour incorrect pricing or accept returns resulting from such errors. Additionally, Airtek reserves the right to approve or decline any order at its sole discretion without providing a reason. If an order is cancelled or declined, a full refund will be issued to the original payment method within 7 business days.
  6. By placing an order, you acknowledge that you have read and agree to the Terms, Conditions, and Policies as published on this Website, which may be updated from time to time, material changes will be communicated to you, and your continued use of the site or services will signify your acceptance of these changes.

Sales Tax

Your online order is subject to applicable federal, provincial or state sales taxes where delivery is made.

Optional Comprehensive Shipping Insurance

Your order includes basic insurance provided by the Shipping Carrier. If you wish to add optional comprehensive shipping insurance, please contact your local Airtek Shop or your Account Representative for a customized shipping quote detailing the comprehensive coverage options.

Tax-Exempt Policy for Deliveries to Reserves in Canada

If you are eligible for tax-exempt as an Indigenous individual or an organization who holds a valid Certificate of Indian Status (Status Card) issued by Indigenous Services Canada, with a delivery address to a reserve in Canada, please email a clear copy of your valid Status Card immediately to your local Airtek Shop or your Account Representative with the subject line: "Tax-Exempt" after placing the order and include the order number. Upon receiving your email, our team will verify your documentation and shipping address within 3 business days and once verified, Airtek will ship the order and issue a refund for the applicable tax portion within 7 business days after verification confirmation.

Please note that orders shipped to non-reserve addresses are not eligible for tax exemption. In some cases, the GST may not be exempt depending on federal regulations. Orders without proper documentation or verification will not be processed as tax-exempt.

This policy complies with the federal guidelines established by the Canada Revenue Agency (CRA) and relevant provincial tax regulations. Airtek reserves the right to modify this policy as necessary to remain aligned with changes in tax laws.

Shipping and Delivery Estimates

When you place an order online, Airtek will authorize your credit card to ensure sufficient credit is available and your card will be charged within 24 hours. In-stock orders are typically shipped within 3 business days after payment is received by Airtek, unless otherwise specified. You take title to the products at the time of shipment. Expected or estimated delivery dates are estimates only, and Airtek is not responsible for delays in transit time.

Delays Due to Unforeseen Circumstances

In the event of delays caused by unforeseen circumstances beyond our control, please be assured that Airtek will make every effort to process your orders as quickly as possible.

Tracking Orders

After placing an order, you will receive an email confirmation with your order details. Once your order is shipped, you will be provided with tracking information, including your order number, the Shipping Carrier's information, and the package tracking number.

At Time of Delivery

All products have been carefully inspected to be in perfect condition before leaving our warehouse and all orders are insured through the Shipping Carrier. Upon receiving your shipment, please:

  1. Count all packages and compare with the quantity stated on the delivery receipt before signing.
  2. Inspect your package for any obvious damage.
  3. Take relevant photos for record if the package is damaged, and carefully open the package and inspect the product. Please send the photos to your local Airtek Shop or your Account Representative so that we can assist you in resolving the issue with the Shipping Carrier.
    • For minor and cosmetic damages, take note of the damages on the delivery receipt and ask for a damage claim form directly from the Shipping Carrier. However, please note that minor damages that do not compromise the operation of the product or the Warranty are specifically excluded under all shipping insurance.
    • In the rare event of significant damage to your package, please email your local Airtek Shop or your Account Representative immediately with the subject line: "Damaged Package". All claims for damaged packages must be reported within 24 hours of delivery. Please include a detailed description of the issue, your order number, and clear photos and short videos to illustrate the issue. Providing photos and videos of the product, order number, tracking number, packaging, and external labels will greatly speed up our resolution process. We will make every effort to assist you promptly.

Inaccurate Order or Order Issue

If you have received a wrong item, have an issue with the order or noticed any missing accessories, please email your local Airtek Shop or your Account Representative immediately with the subject line: "Order Issue". All claims for order issue must be reported within 24 hours of delivery. Please include a detailed description of the issue, your order number, clear photos and short videos to illustrate the issue. Providing photos and videos of the product, order number, tracking number, packaging, and external labels will greatly speed up our resolution process. We will make every effort to assist you promptly.

Undeliverable or Refused Shipment

If a shipment cannot be delivered due to reasons beyond our control, including refusal of delivery without Airtek's prior written consent, or if the contact information provided (such as your phone number or the Dealer Profile) is inaccurate or outdated, the shipment will be handled in accordance with our Return Policy. You will remain responsible for all applicable restocking fees, handling fees, repackaging fees, and related shipping charges.

Shipment Not Received

If your shipment has not arrived within the expected delivery timeframe, please contact your local Airtek Shop or your Account Representative and provide your order number and tracking number. Our team will assist you in tracking the shipment and determining its current status. Delays or lost shipments can occur for various reasons, and Airtek will make every effort to help ensure your order is delivered promptly.

Cancelling an Order Before Shipment

If you wish to cancel your order within 1 hour of placing the order, please get in touch with your local Airtek Shop or your Account Representative, and provide your order details, including the order number, recipient name, phone number, email address, and delivery address to ensure timely cancellation. Airtek may be able to cancel the order and stop the shipment and arrange for a full refund to the original payment method. Changes or cancellation of an order cannot be guaranteed until you receive the cancellation confirmation from Airtek Customer Care team.

Cancelling an Order After Shipment

If you wish to cancel your order after it has been shipped, a 15% handling fee and all associated shipping charges for the package to and from our warehouse will apply. Please be aware that cancellations after shipment are not always successful. If the package is successfully recalled by the Shipping Carrier and returned to our warehouse, a refund will be processed within 7 business days, minus the handling fee and all applicable shipping charges. Order changes or cancellations are not guaranteed until you receive a confirmation from our Customer Care team.

EXCHANGE, RETURN AND REFUND

Exchanges, returns, and refunds are subject to our terms and conditions. Airtek encourages you to review our policies prior to purchasing our products.

Exchange Policy

You may request an exchange within 24 hours of delivery if you receive an incorrect product or one that does not match your order description, and Airtek will cover all related shipping charges. To ensure a smooth process for your exchange, please make sure your exchange meets the following criteria:

The product must remain unmodified, never installed, assembled, or disassembled; and it must be in brand-new and unused condition, with all original tags and labels intact; and including all packaged accessories, instructions and manuals. Additionally, the item must be returned in its original packaging, without any marks, writing, or non-original labels on either the product or its packaging.

Return Policy

You may request a return for any reason within 30 days of delivery by contacting your local Airtek Shop or your Account Representative. A 20% restocking fee will be deducted from the refund amount. To ensure a smooth process for your return, please make sure your return meets the following criteria:

The product must remain unmodified, never installed, assembled, or disassembled; and it must be in brand-new and unused condition, with all original tags and labels intact; and including all packaged accessories, instructions and manuals. Additionally, the item must be returned in its original packaging, without any marks, writing, or non-original labels on either the product or its packaging.

Non-Returnable Items

The following products are ineligible for exchange or return:

  • Final Sale items
  • Open Box items
  • Special Orders
  • Customized products
  • Electronic parts
  • Non-Returnable items
  • Bundled discount sets (unless the entire set is returned)
  • Items exceeding the 30-day return window
  • Items that have been used or damaged
  • Products not purchased directly from Airtek

How to Exchange or Return an Item

You can contact your local Airtek Shop or your Account Representative via email with a detailed description of the reason for the Exchange or Return, and upon approval, Airtek will provide you with an approved Return Merchandise Authorization (RMA) Number and a prepaid return shipping label (at Airtek's expense for exchanges due to our error, or at your expense for other returns) within 5 business days with instructions on how to properly package your shipment with the paperwork and return to us. You are required to coordinate with the Shipping Carrier to arrange for pickup or drop-off of the returned shipment. Airtek will not reimburse costs for self-returns without an approved RMA. Returns sent "Collect" or scheduled for pickup by our carrier will not be accepted.

What to Expect

Once the product is returned to our warehouse, our team will inspect it.

For an approved Exchange, if the product is in brand new and perfect condition with no mark on the box, as described under Exchange Policy, after the inspection process, Airtek will send you the correct product as an exchange within 7 business days after your package is received, and you will receive tracking information including your order number, the Shipping Carrier's information, and package tracking number for the shipment.

For an approved Return, if the product is in brand new and perfect condition with no mark on the box, as described under Return Policy, Airtek will issue a refund within 7 business days. Due to the inspection process and shipping time, please allow 10 business days for your credit (minus all applicable restocking fees, handling fees, repackaging fees and related shipping charges) to appear on your account after your return is received.

Unacceptable Exchanges or Returns

Airtek suggests you not to send back any used or damaged item as exchange, return and refund will be refused unless the product and the package are in perfect and brand new condition.

If the product shows signs of use, installation, assembly, disassembly, damage, or wear, or is outside the 30-day return window, Airtek reserves the right, at its sole discretion, to apply additional deductions from the refund amount. These may include restocking fees, handling fees, repackaging fees, and any related shipping charges. In such instances, if you disagree with the refund amount offered by Airtek, you have the option to arrange or pay for the shipping costs to have the product returned to your original shipping address.

Refund Policy

Refunds are processed exclusively through the original payment method. Depending on your credit card provider and financial institution, it may take up to 10 business days for the refund to appear on your account. If the original payment method is no longer accessible, Airtek can provide a credit voucher for the equivalent refund amount to be used within 1 year from the issue date.

Shipping Charges from the Original Order

Shipping charges to the original delivery address are non-refundable. For returns made under the "Free Shipping" promotion, the shipping costs incurred by Airtek for the initial delivery will be deducted from the refund amount.

Return Shipping Charges

The return shipping charges to Airtek will be deducted from the refund amount.

Defective Product

Please inspect your product thoroughly upon receipt and before installation. If a defect is identified at the time of installation, please contact your local Airtek Shop or your Account Representative while on-site. Our team will assist in diagnosing the issue and provide additional technical info. If the issue cannot be resolved and the product is confirmed to be defective, Airtek will honour its commitment by issuing a Replacement Authorization Number and offering a replacement product at no cost to you within 30 days from the delivery date. Detailed instructions will be provided in a follow-up email from your local Airtek Shop or your Account Representative. Claims for defective products may still be eligible for coverage under the Warranty if reported after 30 days from the delivery date, please contact your local Airtek Shop or your Account Representative for more details.

LIMITED WARRANTY

Limited Warranty Policy

Airtek products are manufactured to the highest standards of quality and craftsmanship. Airtek's Limited Warranty ("Warranty") covers defects in materials or manufacture for products installed by licensed and qualified HVAC professionals, in compliance with all applicable legislations, building codes, permits, requirements and standard trade practices. The installation must adhere to Airtek's installation and operation instructions as well as the Owner's Manual, and the purchaser/owner must follow Airtek's proper maintenance guidelines under normal use and conditions. This Limited Warranty is subject to the provisions, conditions, limitations, and exclusions outlined on our website and may be updated at any time.

  • Free replacement part to replace the defective part
  • Free replacement compressor to replace the defective compressor

To qualify for Airtek's Basic Limited Warranty, all of the following steps must be completed:

  1. The purchaser/owner has to purchase the product from an Authorized Airtek Dealer; and
  2. The purchaser/owner has to have the product installed by licensed and qualified HVAC professionals, in compliance with all applicable legislations, building codes, permits, requirements and standard trade practices.

To qualify for Airtek's Bonus Limited Warranty, all of the following steps must be completed:

  1. The purchaser/owner has to purchase the product from an Authorized Airtek Dealer; and
  2. The purchaser/owner has to have the product installed by licensed and qualified HVAC professionals, in compliance with all applicable legislations, building codes, permits, requirements and standard trade practices; and
  3. The Authorized Airtek Dealer has to properly complete and submit the Airtek Online Product Warranty Registration Form within 120 days of the order date.

The terms of the Warranty are contingent upon whether the product is installed at a residential or commercial property with designated zoning; and whether the Warranty Registration has been properly completed and submitted to Airtek within the specified timeframe.

The Airtek Dealer and the purchaser/owner shall assume full responsibility and risk for the safe and proper installation in compliance with all applicable legislations, building codes, permits, requirements and standard trade practices.

Failure to complete any required steps may result in the warranty being void.

Airtek's Warranty Registration Process

It is the responsibility of the Airtek Dealer to complete the registration process to qualify for one of the industry's best product warranties. Please visit Airtek's Warranty Registration section to complete and submit the Form within 120 days of the order date. The Authorized Airtek Dealer and the purchaser/owner are responsible for retaining a copy of the Product Warranty Registration for their records.

Warranty Commencement Date

The commencement date of Airtek's Warranty is contingent upon whether the product is properly registered with Airtek. Either one of the applicable scenarios will apply:

  1. If the product is properly registered with Airtek's Warranty Registration Program, the Warranty period begins on the installation date for the purchaser/owner at its registered installation location.
  2. If the product is NOT properly registered with Airtek's Warranty Registration Program, the Warranty period begins on the manufacturing date.

The Warranty may be transferable to each subsequent owner of the property for a nominal fee, please refer to Warranty Transferability section.

Warranty Period

Airtek's Warranty Period is contingent upon whether the product is professionally installed at a residential or commercial property with designated zoning; and whether the product is properly registered with Airtek. One of the applicable scenarios will apply:

  1. If the product is professionally installed at a residential property with designated zoning and properly registered with Airtek's Warranty Registration Program, it will fall under the Bonus Limited Warranty – Residential Use terms, which expires after the specified period stated in the Bonus Limited Warranty – Residential Use section.
  2. If the product is professionally installed at a residential property with designated zoning BUT NOT properly registered with Airtek's Warranty Registration Program, it will fall under the Basic Limited Warranty – Residential Use terms, which expires after the specified period stated in the Basic Limited Warranty – Residential Use section.
  3. If the product is professionally installed at a commercial property with designated zoning and properly registered with Airtek's Warranty Registration Program, it will fall under the Bonus Limited Warranty – Commercial Use terms, which expires after the specified period stated in the Bonus Limited Warranty – Commercial Use section.
  4. If the product is professionally installed at a commercial property with designated zoning BUT NOT properly registered with Airtek's Warranty Registration Program, it will fall under the Basic Limited Warranty – Commercial Use terms, which expires after the specified period stated in the Basic Limited Warranty – Commercial Use section.

All Warranty periods shall run concurrently, and only one of the applicable scenarios shall apply to the product. In the event of a claim, the applicable warranty terms and conditions shall govern, and no additional or separate warranties shall be invoked.

Installation by Licensed and Qualified HVAC Professionals

To be eligible for Airtek's Warranty Program, it is the responsibility of the Airtek Dealer and the purchaser/owner that the products shall be installed by licensed and qualified HVAC professionals, in compliance with all applicable legislations, building codes, permits, requirements and standard trade practices, at the expense of the purchaser/owner. The installation must also adhere to Airtek's installation and operation instructions and the Owner's Manual. The Authorized Airtek Dealer and the purchaser/owner are responsible for verifying that the HVAC professionals possess the appropriate qualifications and certifications to carry out the installation.

BASIC LIMITED WARRANTY

Basic Limited Warranty – Residential Use

Airtek warrants its products to be free from defects in materials or manufacture:

Subject to exclusions and provided the product is professionally installed by licensed and qualified HVAC professionals in a residential property with designated zoning, Airtek offers the following Warranty: a 5-year Warranty on the compressor, a 2-year Warranty on parts, and a 1-year Warranty on the remote control, commencing from the order date, with the delivery address considered the installation location. This Limited Warranty is valid only when the product is used for its intended purpose and under normal use and conditions. For a detailed list of exclusions, please refer to the Exclusions to Warranty Coverage section.

Basic Limited Warranty – Commercial Use

Airtek warrants its products to be free from defects in materials or manufacture:

Subject to exclusions and provided the product is professionally installed by licensed and qualified HVAC professionals in a commercial property with designated zoning, Airtek offers the following Warranty: a 2-year Warranty on the compressor, a 1-year Warranty on parts, and a 6-month Warranty on the remote control, commencing from the order date, with the delivery address considered the installation location. This Limited Warranty is valid only when the product is used for its intended purpose and under normal use and conditions. BONUS LIMITED WARRANTY

Bonus Limited Warranty – Residential Use

Airtek warrants its products to be free from defects in materials or manufacture:

Subject to exclusions and provided the product is professionally installed by licensed and qualified HVAC professionals in a residential property with designated zoning, Airtek offers the following Warranty: a 10-year Warranty on the compressor, a 10-year Warranty on parts, and a 2-year Warranty on the remote control, commencing from the installation date at its registered installation location. This Limited Warranty is valid only when the product is used for its intended purpose and under normal use and conditions. Bonus Limited Warranty – Commercial Use

Airtek warrants its products to be free from defects in materials or manufacture:

Subject to exclusions and provided the product is professionally installed by licensed and qualified HVAC professionals in a commercial property with designated zoning, Airtek offers the following Warranty: a 5-year Warranty on the compressor, a 5-year Warranty on parts, and a 1-year Warranty on the remote control, commencing from the installation date at its registered installation location. This Limited Warranty is valid only when the product is used for its intended purpose and under normal use and conditions. Airtek Prestige Dealer Program

The Airtek Prestige Dealer Program is composed of select Qualified Authorized Dealers committed to delivering high-performance comfort solutions, maximizing energy efficiency, and providing exceptional customer service to residential clients.

Warranty Transferability

Airtek's Limited Warranty may be transferrable to each subsequent owner of the property for a nominal fee within the Warranty period. Please contact your local Airtek Shop or your Account Representative and Airtek will provide more information and further instructions.

Exclusions to Warranty Coverage

Airtek is not liable for improper installation, operation, or maintenance of the product, and any installation and assembly shall only be performed by licensed and qualified HVAC professionals. It is the responsibility of the purchaser/owner to ensure that the product complies with all applicable legislations, regulations, and codes, and is suitable for its intended use and operation at the installation location. Airtek makes no guarantees or representations regarding the suitability of any product for a specific purpose. Any damage caused by failure to use, install, or maintain the product in accordance with our recommendations will void the Warranty.

The following is a non-exhaustive list of exclusions, which may be subject to change at any time:

  1. Products that are installed outside of Canada, unless with the prior written approval of Airtek.
  2. All labour, supplies, materials, and associated costs, including but not limited to diagnosis, lodging, transportation, shipping, receiving, handling, removal, installation, and disposal related to replacing defective parts, are the responsibility of the purchaser/owner and are expressly excluded from coverage under the Warranty.
  3. All costs related to purchasing, charging, recharging, adjustment, removal and disposal of refrigerant remain the responsibility of the purchaser/owner and are not covered under the Warranty in any circumstances.
  4. All costs related to maintenance as outlined in the Owner's Manual or installation and servicing instructions, such as cleaning of all air filters, heat exchangers, fans and blowers, any necessary lubrication of internal components and maintenance of external accessories, remain the responsibility of the purchaser/owner and are not covered under the Warranty.
  5. Failure, damage or repairs due to faulty installation, misapplication, abuse, improper servicing, unauthorized alteration, improper operation, or poor maintenance.
  6. Failure due to voltage conditions, blown fuses, open circuit breakers, or damages due to the inadequacy or interruption of electrical service.
  7. Failure or damage due to any external perils, such as floods, winds, fires, storms, lightning, accidents, broken water pipes, frozen water pipes, electrical surges, input power with over or under voltage, corrosive environments, or other conditions beyond the control of Airtek.
  8. Parts not supplied or designated by Airtek, or damages resulting from their use.
  9. Electricity or fuel costs, or increases in electricity or fuel costs from any reason whatsoever, including additional or unusual use of supplemental electric heat.
  10. Any direct, indirect, special, incidental, or consequential property or commercial damage of any nature whatsoever, as permitted by law.
  11. Products operated in unoccupied structures or used for purposes other than their intended use.
  12. Products that have been removed from the place it was originally installed and being reinstalled at another location.
  13. Failure due to incompatible parts, alterations, modifications or improper applications.
  14. Failure from lack of necessary or routine maintenance for the proper operation of the product, such as cleaning of all air filters, heat exchangers, fans, blowers, and any necessary lubrication of internal components or maintenance of external accessories.
  15. Failure due to the use of unauthorized parts, supplies or add-on components that are not supplied by or approved for use by Airtek.
  16. Failure due to the use of dirty, recycled, incorrect type of unapproved refrigerants or lubricants.
  17. Failure resulting from moisture, air, dust, sand, dirt, or similar elements entering the product due to improper handling of parts or components during installation.
  18. Failure caused by continuous use of the product despite malfunction notifications at the display module.
  19. Failure due to mismatching, inaccurate product selection, under sizing, oversizing, improper installation or misuse.
  20. Normal wear and tear and/or consumable items, such as batteries, filters, lubricants, refrigerant, seals, fuses, paint, coating, and cosmetic damage.

Warranty Claim Procedure

To file a Warranty Claim, the purchaser/owner must first contact an Authorized Airtek Dealer to identify the cause of the failure and diagnose the product. Airtek offers diagnostic resources such as manuals and videos for certain error codes, symptoms, or specific electrical and mechanical measurements to assist with proper diagnosis, however, Airtek is unable to remotely diagnose the product or provide solutions. If the Authorized Airtek Dealer determines that the failure is caused by a defective part covered under the Warranty and the Dealer has reported the issue to Airtek before the Warranty expiry date, the Dealer can then contact Airtek to submit a Warranty Claim. Please email your local Airtek Shop or your Account Representative with the subject line: "Warranty Claim" and include a description of the issue with the following information:

  • Proof of purchase of product or proof of Warranty Transfer payment record.
  • A copy of the Airtek Warranty Registration Form (if applicable) with all related documents, showing the model number, serial number, purchase date and installation date.
  • A report prepared and signed by a licensed and qualified HVAC professional including his/her licence number and contact information after the diagnosis, indicating the nature of the defect, name and model number of the defective part, failure date, and if known, the reason for the failure and the remedy determined.
  • Photos, videos and other diagnostic information may be requested by Airtek prior to it processing the Warranty Claim.

Upon receiving the email, Airtek's team will contact the Dealer in 2 to 5 business days with a response. If the issue is covered by the Warranty, the Dealer will receive an email with the approval for replacement parts under Warranty. The Dealer is responsible for the process and costs of shipping and returning the defective part to Airtek for replacement under the Warranty. Upon receiving the defective parts, Airtek will furnish replacement parts to the Dealer, without any charge for the parts if it determines that the parts have failed due to defects in materials or manufacture of the product installed by licensed and qualified HVAC professionals under normal use and conditions, and following proper maintenance guidelines. Any associated shipping costs for the replacement parts may also be covered at Airtek's expense, at its sole discretion and determination.

LIMITATION OF WARRANTIES

To the fullest extent permitted by applicable law, Airtek, together with its subsidiaries and affiliates operating under any other trade names or business styles it may use in any province or territory of Canada within the HVAC and solar sales and services sector, including all successors and assigns (collectively, "Airtek"), provides all products and services on an "as is" and "as available" basis.

Airtek makes no representations, warranties, or conditions of any kind, whether express, implied, statutory, or otherwise, including without limitation any implied warranties or conditions of merchantability, fitness for a particular purpose, durability, performance, quality, title, or non-infringement, all of which are expressly disclaimed. No oral or written information, representation, or advice provided by Airtek or its authorized representatives shall create any warranty, condition, or guarantee of any kind.

Any express warranty that may accompany a product is the sole and exclusive warranty applicable to that product. No dealer, distributor, reseller, installer, or third party is authorized to modify or extend any warranty on behalf of Airtek.

LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Airtek and its subsidiaries, affiliates, licensors, suppliers, contractors, subcontractors, employees, officers, directors, agents, successors, and assigns shall not be liable, whether in contract, tort (including negligence or strict liability), equity, or otherwise, for any:

  • Indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation, loss of profits, revenue, business opportunity, anticipated savings, data, goodwill, or use of equipment;
  • Costs of replacement products, temporary power or water services, downtime, or loss related to systems or infrastructure; or
  • Third-party claims, including but not limited to those arising from personal injury, property damage, or intellectual property infringement.

Airtek's total aggregate liability arising out of or relating to the use of its website, products, services, documentation, or any contractual relationship shall not exceed the actual net purchase price paid by the customer for the specific product giving rise to the claim. This limitation applies regardless of whether the claim arises from a single event or series of related events and regardless of the legal theory asserted.

These limitations and exclusions apply even if Airtek was advised of the possibility of such damages. Some jurisdictions may not allow certain exclusions or limitations of liability, so the above may not apply in full. Where permitted by law, these limits shall still apply.

INDEMNITY

You agree to indemnify, defend, and hold harmless Airtek, its parent company, affiliates, officers, directors, employees, contractors, agents, suppliers, successors, and assigns (collectively, the "Indemnified Parties") from and against any and all claims, demands, suits, losses, damages, liabilities, penalties, fines, costs, and expenses (including reasonable legal and professional fees), arising out of or related to:

  1. Your installation, modification, or misuse of any Airtek product;
  2. Your breach of applicable law or these terms;
  3. Your misrepresentation, gross negligence, fraud, or willful misconduct;
  4. Any claims by third parties for injury, damage, or loss allegedly caused directly or indirectly by your conduct or use of the product;
  5. Any violation of Airtek's intellectual property rights, including trademark misuse, unauthorized branding, or reverse engineering.

This indemnification survives termination of any agreement or warranty and remains enforceable to the fullest extent permitted by law.

IMPORTANT NOTICE

Installation and service of HVAC equipment should only be performed by licensed and qualified professionals. Improper installation or service may result in property damage, personal injury, or death. Airtek is not responsible for any damages resulting from improper installation or service of its products.

It is the customer's responsibility to ensure that all applicable building codes, permits, and regulations are followed during installation. Airtek reserves the right to change any features and specifications without prior notice or obligation.
